Rawsan Furniture: Comprehensive Legal Policy

This document outlines the Terms and Conditions of Service, Privacy Policy, Payment Terms, and Refund/Cancellation Policy that govern the relationship between you (“Client” or “You”) and Rawsan Furniture (referred to as “We,” “Us,” or “Rawsan Furniture”), a leading custom furniture manufacturer and interior solution provider based in Ajman, UAE.

I. General Terms and Conditions of Service (T&C)

1. Scope of Agreement

These terms govern all use of Rawsan Furniture’s website and all services, including design consultation, bespoke manufacturing, supply, and installation of custom furniture, wall cladding, and interiors.

2. Client Responsibilities

The Client is responsible for providing clear and accurate project requirements, accessing the premises for measurements, and ensuring all required permissions (e.g., from building management) are obtained before installation commencement.

3. Intellectual Property (IP)

All design concepts, 3D visualizations, technical drawings, and manufacturing specifications created by Rawsan Furniture remain the intellectual property of Rawsan Furniture until the final project invoice is paid in full. Upon full payment, the ownership of the physical manufactured goods transfers to the Client.

4. Limitation of Liability

Rawsan Furniture shall not be liable for any delays, defects, or damages resulting from external factors, including but not limited to: structural issues within the Client’s property, power outages, or delays caused by third-party suppliers (e.g., specific imported fabric) outside of our direct control. Our liability is limited to the cost of repair or replacement of the specific item manufactured by us.

II. Privacy Policy and Data Handling

1. Data Collection

We collect personal information necessary to fulfill your order and provide our services. This includes:

  • Contact Information: Name, telephone number, email address, and physical project address.

  • Project Details: Measurements, design preferences, material choices, and 3D renderings.

  • Billing Information: Payment method details (processed via secure third-party gateways; we do not store full credit card information).

2. Use of Data

The data collected is used strictly for the following purposes:

  • Processing and fulfilling your custom manufacturing order.

  • Communicating project updates, delivery, and installation schedules.

  • Improving our design services and product offerings.

  • Internal record-keeping and compliance with UAE laws.

3. Data Storage and Security

All client data is stored securely on protected servers and managed in compliance with relevant UAE data protection guidelines. We implement physical, electronic, and managerial safeguards to protect the information we collect. We retain data only for the duration necessary to fulfill the services and comply with legal obligations.

III. Bespoke Manufacturing and Payment Terms

1. Payment Structure

Due to the custom nature of our products, the following payment structure applies to all bespoke manufacturing contracts:

  • Initial Deposit (50%): Required to confirm the order and initiate material procurement and manufacturing. This amount is non-refundable (see Section IV).

  • Mid-Project Payment (40%): Due upon completion of the manufacturing phase and before dispatch for delivery/installation.

  • Final Payment (10%): Due upon satisfactory completion of the installation and final project handover.

2. Manufacturing Tolerance

By confirming an order, the Client accepts that minor variations in colour, grain, texture, or dimension (up to 3mm) may occur due to the handcrafted nature of the product and natural variation in materials (e.g., wood). These variations do not constitute a defect.

IV. Cancellation, Refund, and Returns Policy

1. Cancellation Policy

  • Before Manufacturing (within 48 hours of Deposit): If you cancel within 48 hours of paying the 50% deposit, we may refund the deposit minus any non-recoverable costs incurred for design work or material ordering (e.g., specialty fabrics).

  • After Manufacturing Commences: Due to the bespoke nature of our products, no cancellation or refund is possible once the manufacturing process has begun. The 50% deposit is forfeited entirely, and the Client may be liable for the full contracted amount if the item is substantially complete.

2. Refund and Returns Policy (Custom Goods)

  • General Rule: As all items are custom-made to Client specifications and are not resalable, Rawsan Furniture does not offer refunds or accept returns due to a change of mind, incorrect specifications provided by the Client, or material choices made by the Client.

  • Defects and Non-Conformity: In the event the manufactured item is deemed defective or does not match the approved design specifications due to an error by Rawsan Furniture, we will, at our sole discretion:

    • Repair the item on-site, OR

    • Replace the specific defective component or item, OR

    • Offer a partial refund commensurate with the damage or defect.

3. Warranty

Due to the unique and custom nature of our products, a standard warranty is not automatically provided on all manufactured items. Warranty terms are assessed on a project-by-project basis and must be explicitly confirmed in writing as part of your final quotation and order agreement. While we offer a comprehensive warranty covering structural defects in most cases, please ensure you discuss and confirm the specific warranty coverage when placing your custom order. This coverage does not extend to normal wear and tear, misuse, or accidental damage.

V. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates (UAE) and the local laws of the Emirate of Ajman. Any legal action or proceedings arising out of or in connection with these terms and services shall be subject to the exclusive jurisdiction of the competent courts in Ajman, UAE. By accepting our services, you agree to comply with all applicable UAE government policies and regulations.
